In The Matter of The State V. Kwasi Kyei Darkwah II

In the previous article, we discussed case law in Ghana to reach a firm conclusion that the rape case against Kwasi Kyei Darkwah will not stand any legal muster. I will go further to opine that it should be altogether thrown out ab initio with all concomitant contempt. Absent this, the prosecution is set for an extreme embarrassment regarding the substance of the case itself.

Most people viewing the case are conflating the issue with their personal view of morality. These question why a forty-nine year old person could be engaged in a sexual act with a nineteen year old girl who is young enough to be his daughter. Well, she is not his relative, and the law states that she is above the legal age to marry.
As for this argument about year gap, I must state at the outset that I take it as a personal insult: My father married my mother when he was forty-nine years old and my mother nineteen. They were married for thirty-five years, and I, Samuel Adjei Sarfo, am the product of that union, being the last among my siblings. When my father married my mother, he was older than my grandfather Kwaku Duah, and my grandmother Yaa Mansah. Besides, my late half-brother Adjei Aboagye was older than my mother by some six odd years. It was that marriage that took my mother and her children from extreme poverty to relative success and wealth. Up to this day, there is not a single descendant of Akua Sarpomah who is not a distinguished citizen in some respects. I myself attribute my extreme wisdom and insight to my father Kwasi Agyei ( born in 1896). Today, I will not blink my eyes in giving my eighteen year old daughter in marriage to a person my age provided the person can take good care of her as my father took care of my mother. That is why I am disgusted with those who dare question the moral basis of a relationship between an older man and his younger consort. That relationship always works to the mutual benefit of the parties. Besides, there is nothing in any culture anywhere at any time that frowns upon a marriage in which the parties have stark disparities in age. So this whole moral premise against such a relationship is non-existent, and has been concocted by some disgruntled youth who cannot compete fairly with these older albeit well-to do men who intrude upon their perceived turf. They are yapping today because old age and success have not yet caught up with them and they are angrily hating upon the older men having all the fun with the younger girls. But they are the very people who will be haunting the streets for trophy wives in the latter days of their success when their phallic powers become weaker against their old and boring partners! To me, their present hatred against Kwasi Kyei Darkwah’s fling with a nineteen year old lady smacks of sheer jealousy and envy. Indeed, most people condemning KKD’s shenanigans are, or will be doing the very same thing if they had his fame and glory……….

Now to the main issue: If people consider rape law in the context of this matter, they should go backwards to determine the intent and purpose of the proponents of the law to figure out if they were truly intended for the present situation at bar. If two people walk hand in hand into a hotel and have sex in a bathroom while their relatives are waiting in the main room, can the female now come out to claim that she was raped? Is that the type of scenario for which the rape laws are made in Ghana? Certainly, they are made for the protective class where the individual woman is patently forced to have sex with a partner. They are not made for instances such as the one before us. Then again, how is the prosecution going to assert rape under the circumstances described? How is it going to allege its case in chief? The prosecution is going to have to prove every element of rape according to the law. In Ghana, the term sexual offences is used in Chapter Six of the Criminal Offences Act, 1960 (Act 29) Section 98 of the Act defines rape thus; “rape is the carnal knowledge of a female of not less that sixteen years without her consent.” Thus, to prove rape, the accused person must have 1. had carnal knowledge, which is sexual intercourse (penetration) 2. of a female and 3. there must have been a lack of consent on the part of the female. How is this lady going to show the court, through proper evidence and witness testimony, that there was no consent when all the corroborative evidence show otherwise? Is she going to say simplistically that she said “no” and pushed the man away? Is that how to prove a crucial element of a case of rape? I have thought about this matter for a long time without coming to any conclusion as to how this whole business of rape is going to fare in the courts.

Unfortunately, many commentators simply prove their ignorance by their assertion that the man is guilty as charged….. Indeed, this particular case has also presented the underbelly of the ineptitude of Ghana’s so-called legal luminaries. One of such had the ire to posit that the magistration of the case was done in a court without jurisdiction over the case. I am like, if you have no clue that arraignment could be done in a magistrate court, what else did you study in law school? Then in full glare of the media cameras, another clueless lawyer declared in stentorian voice that as far as rape is concerned, the laws of the country has taken away the power of judges to grant bail. Obviously, this person has not read any law books since he got his degree. Yet KKD’s lawyers, instead of asserting the constitutional and legal grounds for bail, also chose to dwell on the merits of the case whereas the merits of a case has little, if anything, to do with application for bail.

Application for bail is made on strict constitutional and legal grounds, leaving the merits to the trial court! All this can happen in a country where a whole Supreme Court Judge can summon media people before him and incarcerate them without due process on a case of contempt while a whole Bar Association looks on with total approval. Kwasi Kyei Darkwah’s bail must be argued on the basis of the law which simply requires the defense to show among other things that the man is not a flight risk, and that he has such connection with the society that will make him identifiable and available for court; or that he will not pose any danger to the victim or the society. If the matter is viewed using these factors, KKD should be granted bail as soon as possible. But we have shown ourselves to be a nation of negative emotions and a people ready to do others in even if it means sacrificing our freedoms and liberties in the process.

Not long ago, we cried, “Let the blood flow” against certain former leaders who were given some sort of kangaroo trial and shot by firing squad. Long before that time, we had countenanced a sublime dictator as he gradually instituted incarceration without trial and made himself life president and made our dear country one-party-state, thereby abolishing all legitimate opposition. Today, we are stridently shouting for a person to be jailed simply on somebody’s allegation that he raped her. We are not bothering to step back to scrutinize the matter and to question the authenticity of the allegation. Like hounds, we are baying at someone because he is tied to a tree for crucifixion……. But we must remember that the law is like a Swiss watch; take a small part, and the whole device crumbles. Martin Luther King Junior said that a threat to liberty anywhere is a threat to liberty everywhere. Niemöller is perhaps best remembered for the quotation: First they came for the Socialists, and I did not speak out because I was not a Socialist. Then they came for the Trade Unionists, and I did not speak out because I was not a Trade Unionist. Then they came for the Jews, and I did not speak out because I was not a Jew. Then they came for me—and there was no one left to speak for me.

If we are today sitting here shouting “crucify him” because the matter concerns Kwasi Kyei Darkwah, we must be prepared to swing on a day when all of us will be similarly accused by our disgruntled partners. Then there will be nobody to speak for us. As for me, I will end by paraphrasing and amending General Afrifa’s prophetic statement to General Acheampong: I do not certainly want to be arrested on some sort of trumped up rape charges, given some sort of trial and incarcerated. The ancient ancestral proverb makes no sense to me: If you discover that your neighbor’s beard is burning, don’t just fetch water and put it by yours; fetch water and go and pour it on your neighbor’s beard to put the fire out before it spreads to yours. That makes more sense to me!

Celebrity Column: Peace Hyde – How to achieve your goals!

Hello and welcome to this weeks piece of peace, your weekly dose of motivation and inspiration. Today I would like to share on the topic of how to achieve your goals in life.
One important aspect of success is setting yourself goals. In the same way that there are road signs to help drivers find their way to their target destination, goals serve as indicators along the journey of life of how well or badly we are performing. It enables us to identify where we are looking to go and put the right plan in place to make sure we make it.
When setting goals, it is important to make them relevant and realistic to your personal circumstances. Here is a great way to make sure you set the right goals and ensure you are able to achieve them. It is important to ensure your goals are “SMART”:
S stands for Specific- WHAT, WHERE, HOW.
A goal has to be specific, distinct and has to define as much of the goal as possible without ambiguous language. They are your individual target hence use words that clearly highlight the objective that you are trying to achieve.
M is for Measurable- FROM AND TO
A measurement gives feedback and let’s one know when the goal is complete. You have to set the right type of performance metrics to measure how well you are doing at ever stage of the process.
A- Assignable-WHO
Goals must be assignable to individual groups of people. It is important to determine who will perform which role and at what level. Knowing the right people to delegate the right roles to will ensure that you are working efficiently.
R- how Realistic are your goals? Are they even Feasible?
Realistic goals are challenging yet attainable within the given timeframe. Unrealistic goals are as a result of poor planning and therefore inevitably lead to failure. It is important to always set goals that fall within the realms of possibility.
Finally T stands for Time based
With any goal, you need to set an ideal timeframe for achieving it. The timeframe must however always be aggressive yet realistic. For example, no matter how badly one might want a baby it still takes 9 months for a child to be born. You need to ensure your goalsfall within an appropriate timeframe to ensure success.
No matter what field you find yourself in pertaining to your choice in career, it is important to remember, success of any kind is strongly dependent on knowing exactly what you want to achieve and working tirelessly to achieve it. Goals are a key part of that success journey. They focus your efforts and pull all relevant resources together to help you overcome every barrier to failure. Stay focused and stick to your goals no matter what. Persistence beats resistance every time. And always remember, be yourself because everyone else is taken.

Veteran Ghanaian Obra star actress, Nana Yaa is dead

Obra drama series star actress Nana Yaa, real name Lily Ameyaw has passed on at age 55.

The one week celebration of her death is scheduled for Wednesday, January 14, at Sekyere Dumase, near Mampong in the Ashanti Region.

The late Nana Yaa was also for sometime a panelist on Peace FM’s Wo Ba Ada Anaa’programme.

May her soul rest in peace.

Funeral arrangements will be announced later.

One-On-One interview with Pascal Aka, director of award winning movie “Double Cross”

DOUBLE CROSS movie recently won two awards at the just concluded Ghana Movie Awards held on the 30th of December, 2014. The movie which had laudable reviews, a great premiere in UK and won two gongs is set to be premiered in Accra on the 6th of February, 2015, at the Silverbirds Cinemas both at the Accra and Weija Mall as well as the West Hills Mall.

In that vein, we caught up with the man-PASCAL AKA who directed the intriguing piece. In this interview, he spoke about his passion and the inspiration behind the movie that he directed which won for him Best Cinematography and Best Make-Up & Hair Styling.

Hello, Thank You For Your Time, Pascal Aka Started As Being Known For Doing Music Video And Before We Could Say ‘Jack’ You Already Winning Awards For Your Movie. Tell Us How The Journey Has Been So Far.

My initial plan when I came to Ghana four (4) years ago was to make movies, but the music video thing just took off and it took off extremely well especially with the rise of the Azonto movement at the time and the strong creative chemistry I had with EL and his BBnZ management. After some time I was looking for the right movie offers, I couldn’t turn down directing ‘Double-Cross’ because my favourite actress Ama K. Abebrese was going to be in it. It wasn’t hard for Ama K. to convince me to do it at all. It was a challenging production but we pulled it through, but I always knew that cinematography was the least of our problems; my team and I were able to handle that part with our eyes closed.

Your Movie-‘Double Cross’ Won Two Awards At The 2014 Ghana Movie Awards, First How Did You Feel When You Were Nominated And Secondly How Did You Feel That Night Of The Awards?

I was happy when I saw the nomination announcement at the press conference launch, 6 nominations for my first GH movie, we thank God. When we actually won the best cinematography award I was happy but at the same time I knew that I was going to give a mediocre speech that I wasn’t prepared for (jokes). It was a very inspiring event and I will keep working harder to revolutionize this industry.

Do You Feel That Double Cross Should Have Been Nominated And Won More Awards On The Night?

I feel the movie got more nominations than I expected, it was an honour, it makes you feel that all the hardships we went through on set and in post were all worth it. Apart from that, I feel my composer did a fantastic job, so even without a soundtrack nomination I know the fans will appreciate his work and all the different aspects of the film that didn’t get a nomination. It is honestly a good movie throughout.

Currently In Ghana, There Is A Known ‘Pascal’, Who Is Also Doing Well In Directing Movies, Now You Are Another Genius When Movie Directing Is Mentioned, What Is It With The Name ‘Pascal’?

Isn’t Pascal a great name that suits an artistic person? I have my own directing style and my own fan-base. Smart people know there is a vast difference between myself and any Ghanaian movie director. You can start by watching the short films that we put out for free (Mr. Q, Ghana Police, Banku Chronicles and Redemption).

About The Movie Double Cross, What Was The Inspiration Behind It When You Were Directing?

My main goal was to overcome the challenges and still deliver a final film that will stand out from the Ghanaian norm. That is my main priority, to make the story come out in the most effective way possible and push the creative boundaries in the industry. I have an extremely big vision for the future and ‘Double-Cross’ enabled me to have tangible evidence that these plans are possible. It is the first step, the first movie I direct in Ghana so I’d love for everyone to see it before anything else comes out.

How Was It Like, The Synergy Working With Ghanaian Actors And Actresses? Any Appraisal Or Correction Or Any Lashing?

The first day of shooting had both Ama K and Adjetey Anang, watching them rehearse alone was a spiritual experience. John Dumelo was fun to work with. What I learned was that these actors don’t take themselves too seriously; they are all very likeable in person, which makes them very easy to direct. They are all good in their own way, and I now know how to work with each of them differently.

As A Movie Director, Who Left The UK To Come And Work Here In Ghana, How Will You Rate The Movie Industry, How Will You Want To See The Industry In The Next Couple Of Years From Now?

I am actually from Canada. The Ghanaian movie industry is way too monotonous. Everybody is doing the exact same thing, and the fans don’t even seem to be open to new genres or styles, that’s the Ghanaian mentality sometimes, but I take it as a challenge. I broke creative boundaries in the music video industry in 2012 and I will do the same to the movie industry in 2015. ‘Double-Cross’ is a start, we had a great UK premiere, we won 2 awards but now I really pray that the fans will appreciate it. I am excited about the premiere.

We Know That You Premiered This Movie In The UK, How Was The Response Form The People Who Came To See It. Also What Has Been The General Review From That Side Of The World?

The producers of the film are both from the UK (DR. Kuffour and Ama K. Abebrese) so it was fitting to have the first premiere over there first.  I did not attend the UK premiere but I will be at the Accra premiere in full force. When it comes to the acting, I studied it with directing at the same time when I was in Canada, and I acted in movies, short films and commercials there. In Ghana, it all started with my short cameo in EL’s ‘Kaalu’ video; there was a huge positive response for that so once in a while I put my personality on screen. I love acting, it’s one of my artistic crafts that I practice every week, and I sometimes teach it as well.

Vertical construction could ease pressure on land resources in Accra

Accra is growing at a rapid rate and is one of the biggest cities in Africa. In great respects, it is the engine of growth for much of the Ghanaian economy. Due to the heavy investment and allure of the city, it has led to a population boom over the decades.

In 1960, the entire population of Ghana was about  six million. Today, Greater Accra alone accounts for more than half the total population of Ghana in 1960. The country continues to experience a population boom, with an average growth rate of 2.5% annually. Worryingly, Accra’s growth rate is higher than the national average. It is instructive to note that a high population puts pressure on a country’s resources. For instance, the 2010 Population and Housing Census Report indicated that while Northern Region had a population density of 35 persons per square meter, Greater Accra recorded 1236 persons per square meter.

This has led to enormous pressure bearing on resources in Accra and its environs, especially in respect to housing. While the Northern Region has a total area size of 70,384 km2, Greater Accra pales in comparison with its 3,245 km2. So with the over four million people spread over this area, it is clear to see the challenge it poses in respect to availability of land.

In other parts of the world, the consensus has been to shift reliance on vertical construction, also known as high rise buildings. High rise buildings has helped maximize the land resources of many countries and it is time Ghana takes a keener interest in this phenomenon.

Research has shown that demand for high-rise living is increasing in Accra, offering a solution to the growing pressure on housing in Ghana’s capital.

According to data from leading property website, Lamudi, a third of online property-seekers are looking for apartments in the country’s largest city. In late 2014, over 30 percent of searches on Lamudi.com.gh were made for apartments for rent in Accra.

The trend towards apartment living comes as the city continues to see rapid growth. Due to heavy investment and the allure of the city, the population has boomed in recent decades, with Accra growing at a higher rate than the national average of 2.5 percent.Manet_2_opt

KKD rape saga: 19-year-old victim withdraws case

The victim in the KKD rape saga has withdrawn the case from court, according to Starrfmonline.com report.

KKD, real name Kwasi Kyei Darkwah is standing trial for allegedly raping a 19-year-old girl, a charge he has denied.

But the victim, Ewuraffe Orleans Thompson Monday January 12, wrote a letter to the Public Prosecutions at the Attorney General’s Department stating that she was no longer interested in pursuing the case in Court.

According to Orleans Thompson, she wants to put the whole saga behind her and reorganise her life saying “God will give her justice.”

The two-page letter, was also copied to the Chief Justice, the Registrar of the High Court and the top hierarchy of the Ghana Police service.

KKD, who has been on admission at the Police hospital over a swollen foot was not in court today.

Meanwhile, the Human Rights Court in Accra Thursday adjourned the bail application hearing of KKD to Thursday January 15, 2015.

I, Kwasi Kyei Darkwah wish to make this public announcement that I truly and sincerely apologise for the public ridicule and disgrace that has ensued by reason of the fleeting pleasure of the flesh involving Ewureffe Orleans Thompson and myself.

Troubled hiplife artiste, Kwaw Kese has released a new music video for his single “Swedru Agona” featuring rapper Obrafour and Teephlow.

The video was shot and due to be released before his arrest on November 22 by Kumasi Police for smoking substance suspected to be cannabis.

Kwaw Kese returns to court on February.

GFA orders Afriyie Acquah to call wife to order

The Ghana Football Association (GFA) has reportedly asked Black Stars midfielder, Afriyie Acquah, to instruct his wife Amanda Acquah to cease fire regarding her recorded tape video – which has gone viral on social media – on which she has made a litany of sleazy accusations against her former husband and other prominent men in society. The tape is reportedly causing some frenzy in the Stars’ camp in Spain.

According to a deputy management committee member, Cudjoe Fianoo, the tape has reached the camp of the senior national team and confirmed that the vulgar words used by Amanda could potentially ruin the team’s concentration as they gear up for the Africa Cup of Nations.

Captain of the side Asamoah Gyan, alongside Sulley Muntari and John Painstil were mentioned for allegedly having a fling with Muna, the current fiancée of CEO of Kenpong Travel and Tours, Kennedy Agyepong.

The accusation, according to Fianoo is damning and could distort the team’s preparations towards the AFCON, which starts on Saturday, January 17 in Equatorial Guinea.

“It is true that the Ghana Football Association has spoken to Afriyie Acquah to speak to his wife over this issue” Fianoo told Kumasi based Angel FM in an interview.

Fianoo added “the tape…is not healthy at all, this is shameful and it could lead to something else, because some of the current players were mentioned and we don’t want that to happen again so we have instructed him to speak to his wife for future reasons.”

Good News: DStv to activate Supersport 5 on lower bouquets for 2015 AFCON Coverage

DStv is poised to delight African Football fans with the broadcast of the biggest football spectacle, the African Cup of Nations (AFCON).  SuperSport will be the number one destination for all the football action taking place on the pitch in Equatorial Guinea where the 16 qualifying nations will be engaging in a battle to be crowned the ‘Kings of African Football’. Football fans will be even more delighted to know that SuperSport 7 will act as the overflow channel for SS5 at the playoff stage where matches will kick off simultaneously. A selection of matches will also be made available on other channels.

DStv subscribers will have access to all 32 matches from the tournament across four SuperSport channels namely; SuperSport 7, Maximo, Select and SuperSport 9 East (where available) which will be available from Family to the upper tier packages. The live match broadcast will feature dual-language commentary (English and Portuguese) and expert analysis from football legends.

These tips from global property website Lamudi will help sellers find the right real estate agent to match their needs – and get their property sold.

1. Interview them.

Never go into your first meeting with an agent expecting a casual conversation. Treat the meeting as seriously as you would a job interview, with the agent vying for the position and you having the final say. Go armed with a list of specific questions designed to find out more about their experience, sales history and how they operate. As a rule, interview at least three agents before making a final decision.

2. Google them.

These days a person’s online persona can tell you plenty about the way they do business. From their website and social media accounts, including Facebook and Twitter, you will get a good sense of the type of work they do. Do a quick search for any news articles that have appeared about them or their company. Most importantly, take a look at what online marketing channels they use and how effective they are in reaching potential buyers.

However, it was announced at a Lamudi real estate conference that the government of Ghana has approved a Real Estate Bill at the cabinet level. This Bill contains elements guiding the real estate sector meant to improve the industry. 4. Ask for references.

Both buyers and sellers should always ask an agent for written references from past clients, including their contact details. Call some of the agent’s former clients to ask a range of questions: did the agent communicate well? Did they effectively guide them through the selling process? How long was their property on the market? Above all, would they use this agent again?

5. Look for local expertise.

Finding an agent with in-depth local knowledge is key because every neighbourhood has its own challenges when it comes to real estate. The ideal property agent will have a proven track record of selling properties in your local area. They will be well versed in factors including the location of amenities, the local environment and even how government regulations are likely to affect the sale. They will know the ins and outs of the local market better than most residents, and for this reason they will always have the upper hand when it comes to getting your property sold.

6. Remember: asking price isn’t everything.

While many people will be tempted to focus on the estimated selling price, there are other factors that are much more important. An agent’s negotiation abilities, for example, are key to securing the best deal possible, regardless of the asking price. SuperSport to televise the 2015 First Capital Plus Premier League LIVE on DStv and GOtv

The Ghana Football Association (GFA) will officially launch the 2014/2015 First Capital Plus Premier League Season on Wednesday January 14, 2015 at the headquarters of the GFA in Accra.

The much awaited 2014/2015 Ghana Premier League season will officially commence on Sunday January 18 at the various league centers and champions Asante Kotoko will kick off their title defence against away against Aduana Stars at the Agyemang Badu park in Dormaa on Sunday January 18. The match will be televised live at 3:00PM GMT on SS9 209 ON DStv and SuperSport Select 2 on GOtv.

However on Saturday January 17 B.A United will play Bechem at 3:00PM GMT on SS9 209.

The Ghana Premier League, which is broadcast exclusively by SuperSport, will begin on January 18 with the first-round fixtures ending on April 29. The second half of the season is tentatively set to continue from June 7.

The FA Cup competition, whose winner automatically represents Ghana at the CAF Confederation Cup, has been set to kick off with the Round of 64 matches on January 28.
